Cannabis Reformers Want to Boot DEA from Rescheduling Hearings

DEA Accused of Blocking Cannabis Rescheduling

Cannabis companies Village Farms and Hemp for Victory filed a motion on January 6 claiming the DEA is trying to block cannabis from being moved from Schedule I to Schedule III. They allege that:

  1. They discovered communications showing the DEA has already privately decided to oppose rescheduling marijuana, despite being required to approach the hearings with an open mind.

  2. The DEA has been inappropriately communicating with other groups who oppose rescheduling. These discussions should not be happening outside the official hearing process.

  3. Village Farms obtained this evidence through their separate delta-8 case against the DEA, in which they had access to agency communications and documents.

    The key issue is that the DEA is supposed to be a neutral party administering the rescheduling review, not an advocate taking a position. They are required to make their decision based on the evidence presented at the hearings, not predetermined views or private discussions with opposing groups.
